Terms of Service

1. Acceptance of Terms

By creating an account or using Cormorant (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and the operator of Cormorant.

2. Beta Service

Cormorant is currently provided as a beta service. Features may be incomplete, unavailable, or change without notice. The Service is provided free of charge during the beta period. We reserve the right to introduce paid plans in the future with advance notice to existing users.

3. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, bulk-download, or systematically extract data from the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Interfere with the Service's operation or other users' access
  • Misrepresent data from the Service as your own original work

5. Data and Accuracy

Data displayed in Cormorant is sourced from public government datasets including CDFW, PacFIN, ODFW, and NOAA. This data is provided for informational purposes only. Cormorant makes no warranty as to the accuracy, completeness, or timeliness of any data shown. Do not rely solely on Cormorant data for regulatory compliance, licensing decisions, or safety-critical applications. Always consult official agency sources and current regulations.

6. Intellectual Property

The Cormorant application, including its design, software, and presentation of data, is the property of its operator. Underlying fisheries data is sourced from public government datasets and remains subject to those agencies' terms of use. You may not reproduce, redistribute, or create derivative works from the Service without written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA IS ACCURATE OR COMPLETE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORMORANT AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your right to access the Service ceases immediately.

10. Modifications

We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in California.
